1. Agreement to Terms

By accessing or using the Loonza website and purchasing our products (the "Services"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Services.

2. About Loonza

Loonza is an apparel brand offering original, print-on-demand designs. Our store is powered by Shopify, which provides the underlying e-commerce infrastructure.

3. Eligibility

You must be able to form a legally binding contract to use the Services. If you are under the age of majority in your jurisdiction, you may only use the Services with the involvement of a parent or guardian.

4. Products and Availability

  • All products are made to order via print-on-demand production. Colours, sizing, and print placement may vary slightly from images shown due to manufacturing process.
  • We reserve the right to limit quantities, discontinue designs, or refuse any order at our discretion.
  • Prices are listed in the currency shown at checkout and are subject to change without notice.

5. Orders and Payment

  • By placing an order, you confirm the information provided is accurate and complete.
  • Payment is processed securely through Shopify's payment infrastructure. We do not store your full payment card details.
  • We reserve the right to cancel any order suspected of fraud or error, including pricing errors.

6. Shipping

  • We ship to all Canadian provinces and territories.
  • Shipping timelines are estimates, not guarantees, and depend on production and carrier timelines. Remote areas (e.g., Nunavut, Northwest Territories, Yukon) may experience longer delivery times.
  • Risk of loss and title for products pass to you upon delivery to the carrier, though we'll assist with claims for lost or damaged shipments per our Return and Refund Policy.

7. Returns and Refunds

Returns, refunds, and exchanges are governed by our separate Return and Refund Policy, which forms part of these Terms.

8. Intellectual Property

  • All designs, graphics, logos, and content on the Services are the property of Loonza and protected by copyright and trademark law.
  • You may not reproduce, distribute, modify, or create derivative works from our designs or branding without our prior written consent.
  • Purchasing a product grants you no rights to reproduce or commercialize the design itself.

9. User Conduct

You agree not to:

  • Use the Services for any unlawful purpose
  • Attempt to interfere with, hack, or disrupt the Services
  • Submit false, misleading, or fraudulent information
  • Infringe on Loonza's or any third party's intellectual property rights

10. User-Generated Content

If you submit reviews, comments, or other content to the Services, you grant Loonza a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content for business and marketing purposes. You're responsible for ensuring your content doesn't infringe on others' rights or violate any law.

11. Third-Party Links and Services

The Services may contain links to third-party sites (e.g., Shopify, payment processors, social media). We are not responsible for the content, policies, or practices of third-party sites.

12. Disclaimer of Warranties

The Services and products are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement, to the extent permitted by law.

13. Limitation of Liability

To the maximum extent permitted by law, Loonza is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services or products, including but not limited to loss of profits, data, or goodwill. Our total liability for any claim is limited to the amount you paid for the product(s) giving rise to the claim.

14. Indemnification

You agree to indemnify and hold Loonza harmless from any claims, damages, or expenses arising from your violation of these Terms or misuse of the Services.

15. Quebec Consumers

If you are a consumer resident in Quebec, nothing in these Terms limits any rights you have under the Quebec Consumer Protection Act.

16. Changes to These Terms

We may update these Terms from time to time. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms. We'll update the "Last updated" date accordingly.

17. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles, subject to Section 15 above for Quebec consumers.
